A UK-based technology supplier, Offtek Ltd, is facing legal action after failing to honour its written promise to refund the cost of faulty computer memory supplied to Mayside Partners Limited, the parent company of WireNews.
The dispute centres on a 32GB replacement memory module sold by Offtek. The module, advertised as a DDR4-25600 (PC4-3200) upgrade, was purchased for £93.83. Upon installation, the component was found to be defective.
As a result of the defective part, which corrupted multiple Windows installations, company documents and records were destroyed — many of them permanently.
Over a three-week period, Mayside Partners was in contact with Offtek’s sales and technical support teams, who repeatedly insisted that the part was fully operational. Eventually, it was determined that the RAM was indeed defective.
Mayside Partners then provided Offtek with a detailed report outlining the fault. Offtek responded by email, promising a full refund upon return of the item. The defective memory was returned promptly. However, after receiving the item back, the company reneged on its written commitment to refund the purchase price.
As a result of Offtek’s failure to act in good faith, Mayside Partners incurred three weeks of technical support and labour costs while diagnosing and resolving the issues caused by the faulty memory. These costs amount to £7,500 (£500 per day for 15 days, inclusive of VAT).
On 8 October 2025, Mayside Partners issued a formal Notice of Claim to Offtek Ltd for the total sum of £7,593.83. The company has been given seven business days to make payment, failing which the matter will be escalated through the County Court.
This case raises serious concerns about the reliability of refund assurances in the technology sector. Offtek’s written promise to refund — and its subsequent refusal to honour that promise — casts doubt on its business practices and commitment to consumer protection standards.
Mayside Partners has confirmed its intention to pursue the matter through legal channels if full payment is not received within the stipulated timeframe.
